It seems that as Jan 1, 2024 the Chinese Tech Company Tiktok could be banned in the state of Montana. Montana’s Gov. Greg Gianforte signed a bill that would make downloading the popular Tiktok app illegal. A penalty of $10,000 per day would fine any “entity” that allows Tiktok to be downloaded on its platform. The measure was voted 54-43 by the House in favor of a total ban of the TikTok app.
Tiktok is most popular with teens and young adults because the platform allows them to create and share short videos in a three second to ten minute span.
According to Jack Shepard of the website Social Shepard:
"US Stats for 2023 show that the ages of 10 to 19 make up 25% of its users, ages 20 to 29 are 22%, and ages 40 to 49 are 20% of its users."
Governor Gianforte of Montana
Even though security concerns arise from possible invasion of privacy and the Chinese Government recording data, Governor Gianforte faces backlash and possible legal challenges. An Executive Order to ban Tiktok was attempted by President Trump, but was blocked in Federal Courts by Judge Wendy Beetlestone in 2020.
Is it a violation of Constitutional Rights? Tik-Tok CEO Shou Zi Chew testified in a Committee Hearing that the company plans to store all data on Oracle Servers. Brooke Overwetter, spokesman for Tiktok argued the ban is unlawful and infringes on their First Amendment Rights. Gov. Gianforte's Senate Bill will protect the personal, private, and sensitive data of the residents of Montana.
